Running Stop Signs/Red Lights

Traffic violations for running stop signs and red lights aren’t just minor infractions. They can attract hefty fines, points on your record, or even increased insurance rates.

Attempting to handle these traffic citations on your own might seem straightforward. Just pay the fine and move on with your life, right? But many people don't understand that traffic laws can be complicated, and admitting guilt can impact your driving privileges for years.

At Buss Law, I’ve dedicated my career to helping drivers in Wisconsin handle traffic violations effectively. With years of experience, I bring a personal approach to every case, tailoring my strategy to your needs.

With a firm located in Wauwatosa, Wisconsin, I strive to protect your rights, minimize the impact of traffic violations on your record, and avoid penalties as much as possible.

Consequences of Running Stop Signs or Red Lights

Traffic signals and stop signs are in place to promote safety on the roads. Ignoring them isn’t just risky—it can lead to serious safety issues, costly legal troubles, and financial headaches.

If you’re cited for running a stop sign or red light in Wisconsin, here’s what you could face:

  • Fines: Typically ranging from $20 to $100 for a first offense, though subsequent violations can attract higher penalties.

  • Points on your driving record: Wisconsin uses a point system for traffic violations. Running a stop sign or a red light can add 3 to 4 points to your record. Accumulating 12 or more points within a 12-month period can result in the suspension of your driver’s license.

  • Possible license suspension: For repeat offenses or serious violations, you may even find your driving privileges temporarily suspended.

  • Higher insurance rates: Traffic violations like these often raise red flags for your insurance provider, possibly leading to increased premiums.

  • Court appearances: Some violations might require you to appear in court, which can be time-consuming and stressful.

Wisconsin Laws Governing Stop Signs & Red Lights

Understanding Wisconsin traffic laws is important if you’ve been cited for running a stop sign or red light. Here's what you should know:

Running Stop Signs

Wisconsin Statute 346.46 states that drivers must stop at stop signs where required. You must stop at the marked stop line if there is one.

If there’s no stop line, you must stop before entering the crosswalk. If both are absent, you must stop at the point nearest the intersecting roadway where you can safely see approaching traffic.

Failing to do so may result in a fine, addition of points to your record, and increased scrutiny by law enforcement. Missing, obscured, or poorly maintained stop signs can serve as a valid defense in certain cases.

Running Red Lights

Wisconsin Statute 346.37 mandates that drivers come to a complete stop at a red light and only proceed when the signal changes to green (unless making a permissible right turn on red as allowed by law). Even then, they must first come to a full stop and yield to pedestrians or other vehicles.

Violations of this rule can carry more penalties in cases where running a red light results in an accident or endangers other road users.

Tips to Avoid Future Violations

While my role is to assist you after the fact, it never hurts to adopt safe driving practices to avoid citations. Here are a few tips to keep in mind:

  • Always slow down when approaching an intersection, especially if visibility is limited.

  • Double-check intersections for pedestrians, cyclists, and other vehicles, even when you have the right of way.

  • Follow the "stop-count-three" rule at stop signs. Fully stop, and count to three before proceeding.

  • Keep your focus on the road, not on distractions like your phone or the GPS.
